Simon's father John Hughes had died in Smith County, Tennesse back in 1827 and left a considerable estate. He went to claim his portion many years later and filed several court documents contesting the handling of his father's estate by his sister Nancy's husband who happened to be the executor and sheriff at the time. It took many years to resolve the contested estate but it was found that John Biggers Hughes did mishandle the estate and unlawfully benefited from it and a judgement was handed against him and his heirs.
Simon remained in Smith County, Tennessee for several years even after the death of his wife Besty Coleman Biggers. He eventually returned to Prince Edward County, Virginia to live with his son John P. Hughes where he died in December, 1859.
