Benjamin F Burks was the son of James L and Eunice Burks and was born In Georgia. The family lived in Scott County, Mississippi according to the 1850 US Federal Census. Children in the home at the time were: Benjamin F (20), Mary Ann (18), Thomas J (17), Lemuel A (9), Silas W (7), Berry M (4), and Rufus L (1).

By 1860 he had married Emily Smith and they were the parents of four children: Margaret (5 ), John S (3), Burton (2) and Babe (3 months). They were living in Hillsboro, Scott County, Mississippi

On March 1, 1862 Ben enlisted in the 2nd Mississippi Cavalry, Company S as a Captain and later appointed Assistant Quartermaster. On July 15, 1863 he was mustered out.
