A short time after the marriage to Mary Donohue a scandal arose and David employed Thomas Jefferson to represent him in a suit against James Burnside, who had accused Frame of adultery with a widow, Elizabeth (Hanna) Botkin.
On March 22, 1769 Mary (Donohue) Frame relinquished her dower to David, effectively divorcing him. He immediately married Elizabeth (Hanna) Botkin.
In 1772, David and Elizabeth bought a farm on the Cowpasture River in present day Bath County, Virginia. They lived on this farm through the American Revolution. David served the Colonies as a Private in Captain McCreery's Augusta County Troops of the Virginia line.
In 1797, the family moved to Greenbrair County, Virginia and later to Little Levels. In 1801, they moved to Big Birch River, near the mouth of Powell's Creek, in present day Nicholas County, West Virginia.
