Last Will and Testament of Oliver Burch (father of Anne Burch)
In the name of God Amen, I Oliver Burch of King and Queen Parish in Charles County being in perfect health& of sound mind and memory
blessed be God for the same and calling to mind the uncertainty of this world that there is nothing certain but death and that most
uncertain, when do make and ordain this my Last Will and Testament in a manner and form following (Viz) ----
Imprimis: I give and bequeath my soul into the hands of Almighty God that gaveth me- Doubting nothing but that through the merits and
intercession of my Blessed Savior and Redeemer Jesus Christ I shall receive it again at the last day with a full pardon of all my sins my
body to the Earth to be buried in a Christian like manner at the appointment of Executors hereafter by me named and as for the worldly
goods that it hath pleased God of his goodness to endow me with all, I bestow in manner and form the following ~ viz. ~
Item: I give and bequeath to my son Benjamin Burch Seventy Five acres of land it being part of a tract of land called, Bowlings Plains to
him and his heirs forever.
Item: I give and bequeath to my two sons Thomas and John Burch five shilling sterling a piece.
Item: I give and bequeath to my son Edward Burch one feather bed and covering, I give the said goods to my son Edward Burch.
Item: I give and bequeath to my son Jonathan Burch the two tracts land the one called Lumley and Penrick, I give to the said land to
my son Jonathan to him and his heirs forever.
Item: I give and bequeath to my daughter Katherine Swann five shilling sterling.
Item: I give and bequeath to my daughter Anne Swann five shilling sterling.
Item: I give and bequeath to my daughter Barbary Allison five shilling sterling.
Item: I give and bequeath to my son Justinian Burch five shilling sterling.
Item: I give and bequeath to my daughter Elinor Burch five shilling sterling.
Item: I give and bequeath to my daughter Elizabeth Cade five shilling sterling.
Item: I give and bequeath to my beloved wife Barbary Burch the plantation whereon I now live with all the Land there unto belonging
during her natural life and after to fall to my son Jonathan and his heirs for ever
I nominate and appoint my well beloved wife Barbara Burch whole and sole executrix of this my Last Will and Testament revoking all other
wills or will by me formerly made ratifying and confirming this and none other to be my last will and testament. In Witness where of I
have hereunto set my hand and seal this 15 day of February 1726

At the post of the aforegoing Will was thus written (viz)

May 24th 1729 then came George Brett and made Oath on the holy Evangelist that he saw the above named Oliver Burch sign and seal the above and heard him publish and declare the same to be his Last Will and Testament and that at the time of his so doing he was of sound and perfect memory to the best of his Judgement and that no other no other sponsor was called at that time as a witness on subscribed as such.
Sworn before me ~ J. Hanson D. Combs
James Phillips being present when the above probate was made & declared that the above Will was brought to him some time after it
was signed and he and his wife were desired to subscribe the same as witnesses which they did but not in the presence of the Testator not
at his request neither did he the Said James ever hear him mention anything concerning said will either before or after.
