Be it remembered that I, William Cummings, 2nd of Freetown in the County of Bristol and Commonwealth of Massachusetts of lawful age and sound and disposing mind and memory, do make publish and declare this my last will and testament in manner following:

First - I give and bequeath unto my wife Mary all my household furniture

Second ~ I order all my just debts to be paid out of my estate.

Third ~ I give and bequeath unto my wife Mary all my personal property wherever it may be found after payments of my just debts and Legacies.

Fourth ~ I give and bequeath to my son Thomas B. Cummings and to my Benjamin Cumming and to my son Joseph T. Cummings and to my daughters Almy B. Cummings and Rachel S. Green, each one dollar and to my grandchildren, Malinda P. Cummings and Charles D. Cummings, one dollar each and to my grandchildren Alfred B. Tallman and William A. Tallman, one dollar each and to my grandson John T. Russell, one dollar, and to my step daughter Mary Packard one dollar.

Sixth ~ I wish to be buried in the Burden (or Borden) Burying ground, at the head of the grave where my son in law Alexander Tallman is laid, and suitable stones placed at my grave. (On the 1860 map of Freetown, there was a Borden family that lived in this area.)

Last ~ I do hereby nominate, constitute and appoint my wife Mary Cummings to be Exectrix of this my last will and testament.

In witness whereof I have hereunto set my hand and Seal this Eighth day of April in the year of our Lord Eighteen hundred and fifty nine.

Signed, William Cummings (very shaky signature)

This will does not mention his daughter Caroline (Cummings) Russell who was living with him in 1850 and died in 1854, nor his daughter who married Alexander Tallman.
