Will of Thomas Carraco

In the name of God, Amen!
I, THOMAS CARRACO, of the County of Carroll and the state of Kentucky, being of sound mind and disposing memory, but aged and infirm in body and calling to mind the mortality of man and knowing it is appointed unto all men once to die, and wishing to avail myself of the right secured to me by the laws of my country to dispose of my estate according to my own wishes and will, do make, ordain, and publish this instrument of writing as my last Will and Testament, hereby revoking all other wills by me heretofore made.

ITEM: I recommend my soul to God who gave it and my body to the tomb to be buried in a plain and decent manner at the discretion of my friends.

ITEM: I give and bequeath to my trusty friend, LEVI ABBETT as Trustee in Trust for the use and benefit of my granddaughter, HELEN GERTRUDE CARRACO, eighteen acres of land on the Southwest side of the KY River, part of the survey for which I hold Tho. Smith's deed on the lower end of said survey, commencing at the lower side of the first creek above E. J. CARRACO's house, running forty rods up the creek, thence across the creek and running up the river for quantity, with the right (inasmuch as there is a convenient site for a mill on this piece of land) to construct a mill race across any part of the land now owned by me, by paying to the devisee of the land through which it may be desired to construct such mill race for so much land as may be appropriated to that use at the rate of fifteen dollars per acre, also the following tract of land to wit: Beginning at N. B. CARRACO's lower corner (as herein after designated) on the river, running with his line with its several courses to the southwardly corner of the land purchased by Con of Pendegras thence running with Cox's line northwestwardly course till it comes opposite the corner of the land I sold Ben Waller, thence with the line dividing my land and Whitehead's heirs, with its several courses to the creek, thence down the middle of the creek to the river, thence up the river and binding thereon to the beginning. Also, the following parts of lots #136, #137, #138 in the town of Carrollton, to wit. Beginning at the Northeast corner of lot #136 at the intersection of Main and Market Sts., thence down Main to the eastern boundary of the ground I sold Parry, thence at right angles across to M. Giltners' lot, thence eastwardly to Market and with Market northwardly to the beginning. Also the following slaves to wit: Julia Ann about 14 years old, William about 10 years old, and Allen about 4 years old. Also all the cash, cash notes and debts due and owing to me at my death or which may thereafter become due, after payment of all my just debts, this bequest is upon trust and confidence that the said Abbett shall rent out the land and real estate, hire the slaves, and loan the money in such manner to make it profitable, the proceeds or so much thereof as may be necessary for that purpose to be applied by him to the maintenance and support and education of my said granddaughter, HELEN GERTRUDE CARRACO, in case her father shall permit the said Abbett to have the care, custody and control of my said granddaughter, for which purpose it is my desire that the said Abbett shall be appointed by the County Court, her guardian, but if Abbett shall not be permitted to have the charge and custody of her person and control of her education, it is my will and desire that the profits of the estate bequeathed, be added annually to the principal and invested so as to make it profitable, and the whole delivered over to my said granddaughter when she shall attain to the age of twenty-one or marry....but in case my said granddaughter shall die without issue surviving her, either before or after her majority or marriage, then and in that case, it is my will and desire that the said estate or so much thereof as may remain undisposed of or unenpended by her return to my estate and descend to my heirs at law.

ITEM: I give and bequeath to said Levi Abbett as Trustee for my granddaughters, SARAH LOUISA CARRACO and CATHERINE E. CARRACO, one hundred acres of land on the southwest side of the Kentucky River (and part of the same survey out of which the eighteen acres has already been bequeathed in trust for my granddaughter, HELEN GERTRUDE, and to be laid off adjoining the said eighteen acres) also all the residue of the lots in the town of Carrollton which I may own at the time of my death not herein specifically bequeathed, in trust and confidence that the said Abbett shall manage the same in the best manner he can to make the property profitable, the proceeds to be applied annually to the support, maintenance, and education of my said granddaughters and the property to be delivered over to them when they shall respectively attain to the age of twenty-one years or marry, but in case they or either of them shall die without issue surviving them before attaining that age or afterwards, the property or the share of such one as may so die without issue to return to my estate and descend to my heirs at law.

ITEM: I give and bequeath the balance of the land on the southwest side of the Kentucky River purchased of Tho. Smith to ELZY J. CARRACO and JESSE H. CARRACO, to be equally divided between them, to them during their lives and to their children after their death or such of their children as may survive them, but in case said ELZY or JESSE shall die childless, the share of such one as shall so die without issue surviving to return to my estate and descend to my heirs at law.

ITEM; I give to my son, NAPOLEON B. CARRACO, the following described tract of land on the northeast of the Kentucky River, beginning at the lower corner of Elijah Demint's land, running down the river and binding thereon till it passes the third row of apple trees in the orchard and corner on the river, thence at right angles or nearly so and in the middle between the 3rd, and 4th row of apple trees to a corner about one rod back of the orchard. thence at right angles or nearly so northwestwardly passing four more rows of apple trees and corner there, thence a straight course to the County Road leaving the old brick house and yard about twelve feet on the northwest side and corner at the road, thence a north course till it strikes the line dividing the two tracts of land that I purchased of Waller and Pendegras, thence running a north-eastwardly course and with the line of the land I purchased of Ben Waller to the corner and thence with the back line to Aliff's line, thence with Aliff's and Demint's line to the beginning. I give and bequeath the said land as described to my said son, NAPOLEON during his life and to his children as such may survive him at his death, and in case he shall die without issue surviving him, it is my will and desire that the same return to my estate and pass by descent to my heirs at law.

ITEM: I give and bequeath to my daughter, CATHARINE BROWN, five dollars and no more, having heretofore made ample provision for her out of my estate.

ITEM: I give and bequeath to WILLIAM THOMAS CARRACO, son of JESSE H. CARRACO, the house and lot in Carrollton which I purchased of E. J. CARRACO and S. H. COYE, and which was formerly occupied by them as a store house. I give and bequeath the said house and lot to the said WILLIAM THOMAS CARRACO during his life and to his children after his death, but should he die without issue surviving him, it is my will and desire that the same return to my estate and pass by descent to my heirs at law.
Lastly I nominate and appoint my friend, Levi Abbett, sole Executor of this my last Will and Testament, with full power and authority to carry the same into full effect.
In testimony whereof I have signed, sealed, executed and published this instrument of writing as my last Will and Testament this 24th day of August, 1846.

Thomas Carraco.
