Killed on 12 May 1864. The notification letter sent to his wife, Sarah Elizabeth Lawrence Merritt read as follows: "Your husband corporal F. T. Merritt , acting Sergeant Major, was killed in battle, at Spotsylvania Courthouse House on May 12, was shot through the heart and never spoke again".

After his wife Sarah Elizabeth Lawrence Merritt died in 1916, her ashes were buried on this site.
