He was a member of the legislature of Alabama sessions of 1898-1899 and of 1900-1901. His military career was a marked one: he was captain of Company F, Alabama National Guard 1886-1890; Lieutenant-colonel of the Second regiment ANG 1890-1897; colonel of the same command1897-1900; major of the United State infantry in the Spanish-American War of 1898, mustered into that service in May 1898 and mustered out in October 1898. In politics Henry was a Democrat, having, at times, served as the chairman of the Democratic executive committee of Tuscaloosa County. He was a delegate to the Democratic National Convention in Chicago in 1896. He was a deacon in his Baptist church.
In fraternal affairs, he was an Elk, an Odd Fellow, Knight of Pythias, and a member of the Woodmen of the World. He married Jennie Hester of Tuscaloosa, daughter of Dr. William Hester and Sallie Hays Hester, on July 24, 1895. He has three children: Henry Bacon Foster, Jr., William Joshua Foster, and Sallie Olivia Foster.
