Upon the petition of Christian Fox and Magdalena his wife, late Magdalena Ernstberger, widow, administratrix with the settlement of Henry Ernstberger deceased, annexed to this Court, setting forth that the said decedent left behind him a personal estate amount to one hundred and six pounds nineteen shillings and six pence and no more as by an inventory thereof appears. That he was seized or possessed of a certain tract of land situate in Donegal township in Lancaster county, containing two hundred and twenty-five acres and by his said testament gave unto his petitioners Magdalena a third part thereof, but did not by his said testament make any distribution of the other two thirds parts thereof but died intestate as to the same. That the debts of the said decedent do amount to L307,,1,,0, as by the account thereof to the said petition annexed also appears so that the personal estate is not sufficient to pay the said debts by the sum of L200,,1,,6 That the said petitioners are desirous and willing that not only that part of the said tract of land not disposed of by the said testament but also the third part thereof so as aforesaid given to the petitioner, Magdalena may be sold to enable them to pay off the Debts of the said decedent. And praying the Court to make an order empowering them to sell and convey the said tract of land to enable them to pay off the said decedents debts according to the Act of assembly in such case made and provided, they the said Petitioners being content to take the third part of what money shall remain after the payment of the said debts in lieu of her third part of the said land. Located on the site of present Adams Co. National Bank building, where a Union Church was built about 1787. A 1909 publication reported that N. A. Gobrect found "over 1200 graves", many with "no stones or markers, many of those having been broken off or pulled out by vandal hands to be piled up, with few exceptions in the corner of the old graveyard." In 1922, D. C. Jacobs reported that on 26 May the remaining broken stones were gathered from the weeds and rubbish and buried on the southeastern portion of the cemetery where inscriptions could be read. Records were made of them before the stones were buried.
