L. C. Kesler Dead
Coounty Commissioner, Leander C. Kesler, died at his home near Highland about midnight Tuesday.
Death was caused by typhoid fever.
He had been sick about three weeks.
His death came as a surprise and shock to everyone as the reports received here had been that he was improving.
Mr. Kesler was aged about 47 and leaves a wife and one daughter.
He was serving his second term as County Commissioner, having been elected to his second term in November 1905.
He was a Democrat and the popularity and the high esteem in which he was held by the people of the county is shown by the fact that he was twice elected to the responsible position of commissioner in a Republican County.
He was by occupation a farmer and breeder of fine horses.
The funeral will be held at Highland Saturday morning at 10 o'clock.
The death of Commissioner Kesler will make necessary the selection of another candidate on both the Republican and Democratic tickets.
Mr. Kesler had still about about one year of his term to serve, his time, not expiring until the third Monday in September 1909.
The law provides that when the death of a commissioner occurs more than thirty days before the next general election that his success must be elected at that time.
The vacancy thus made until the election can be filled by appointment by the Auditor, Probate Judge and Recorder if the interest of the county demands it.
There seems to be no need as the election will occur so soon for any appointment to fill the vacancy as there will be only one meeting of the Commissioners before the vacancy will be filled by election.
There seems to be considerable doubt as to when the Commissioners elected this fall will take office. The law passed April 1906, provided that the Commissioners elected shall take office the first of December following his election.
Kesler's time did not expire until September 1909, and Bennington's expires at the same time. It is a well established principal of law that a term of an officer cannot be shortened after his election. Thus the question arises when will the Commissioners elected this fall go into office?

The funeral of L. C. Kesler was held at the M. E. Church Saturday morning conducted by Rev. L. A. Washburn, assisted by Rev's. L. A. Washburn and by Rev's J. W. Knise and E. Knox.
The high esteem in which he was held was evidenced by the large company of friends and neighbors who attended the funeral services and followed his remains to their last resting place in Highland Cemetery.
His upright and worthy Christian Character had greatly endeared him to all who knew him and the place made vacant in the church by his sudden taking away will not soon be filled.
