John I. Black was released here late Monday afternoon by order of district judge A. J. Fires on a bond of $7,500, subject to a hearing set for Monday, August 15, in the district court, after habeas corpus proceedings were instituted by the defense lawyers.
News that the preliminary trial would be held in the court of Judge P. W. Myers drew a crowd of more than 100 persons to the courthouse Monday morning, but the hearing was postponed one week because of evidence that the State expected to procure before the hearing. Charges for murder of his father, A. E. Black, were made here Saturday, July 30, against Black by District Attorney Jimmie Mahan, after a gun had been found 50 yards from the scene of the shooting, and have held him in jail for the past eight days.
Investigation and questioning have failed to shake Black from his original story that an unidentifted man killed his father at their camp, near Salt Fork River, and that he was awakened by the shot. When the gun was discovered, Black said he had never seen the pistol before. Ownership of the gun was thought to have been established, however, when J. R. McClure, 1605 Boulevard, Fort Worth signed a sworn statement that he sold a gun of similar description to the slain man about a year ago. McClure reported that he sold A. E. Black a double-barreled Dunger-Remington pistol of .41 caliber. The weapon was nickel plated.
Funeral services were held here for Aubrey Edwin Black Thursday afternoon from the Ellis Funeral Home, with the Rev. T.M. Johnston in charge. Young Black was permitted to leave the jail, under custody of officials, and attended the funeral. Mrs. Pearl Reed of Cisco, former wife of the estranged man and mother of the boy held for murder, was also present for the services. Other relatives who attended were Mrs. Blanche Wallace of Hobert, daughter of the slain man; Willie Wilson of Fort Worth, brother of Mrs. Reed. Interment was made in the Wellington cemetery by the Ellis Funeral Home. He is also survived by his wife, Mrs. Mattie Black.
