Deed To 135 Acres of Land
I Elijah Neely of the County of Cannon
and State of Tennessee for the Love and
affection that I have and entertain
for my three Sons Robert Walkup Neely
Nathan Lyon Neely and James Blakely
Neely and also for my daughter Polly
Jane Neely and for other considerations
herein after mentioned do hereby sell
give grant and convey to the said R. W.
Neely, N. L. Neely, J. B. Neely and
Polly J. Neely my children a certain
Tract or Tracts of Land lying and being
in the County of Cannon State of
Tennessee and being the place upon
Which myself and family now live

Containing in all about two Hundred
and thirty five acres more or less and
Bounded as follows. On the South by the
Lands now owned by James Wood and
George W. Thompson. On the East by the
Lands now owned by Robert O. Walkup
and James B. Elledge. On the North by the
Lands of John E. Mason and Elizabeth
Neely the Widow of Nathan Neely deceased
and their children. and on the West by
the Lands of Samuel Vance and the
McBroom Land. And being the same
Lands that was bequathed{sic} to me by my
Father in Law James Barkley Deceased
and also the Lands that I purchesed of
George T. Ford, Joseph Ramsey and David
M. Jarrett and under the Decrees and
Orders of the Chancery Court of Woodbury
Tennessee in the Suit against the Heirs
of Nathan Neely deceased.
To have and to hold the said Tracts of
Land to the said Robt. W. Neely, Natha{sic}
L. Neely, James B. Neely and Polly J.
Neely jointly and severally their Heirs
and assigns forever. I do covenant with
the said R. W. Neely, N. L. Neely, J. B.
Neely and Polly J. Neely that I am
Lawfully seized of said Land have a
good Right to Convey it and that the
same is unincumbered. I do further
Covenant and bind my self my heirs
and Representatives to Warrant and
forever defend the Title to the said Tract
of Land to the said Robert W. Neely
Nathan L. Neely, James B. Neely and
Polly Jane Neely and to thir{sic} Heirs

And assigns against the Lawful claimes
of all persons Whatever.
But it is hereby futher Stipulated
agreed and understood that my wife
(the mother of the parties donus{sic}) is to
be Supported and maintained suitably
comfortably and properly during her
Nutral{sic} life out of and off of the
Lands herein conveyed or the proceeds
thereof and that the support of my
wife Lydia Neely, the Mother of my
children aforesaid during her Natural
life Comfortably and properly is
and Shall constitute a Special charge
and lien upon said Land herein convey
-ed and Which is a part of the consider
-ation of this Deed or the proceeds
arising therefrom.

FACT ONE: His daughter Mary Jane NEELY was born in 1828 in Warren (now Cannon) Co., TN. & married Donelson / Donilson "aka Don / Donn" BARKER on March 1st, 1866 in Cannon Co., TN. & she died sometime after the 1880 Census in Rutherford Co., TN. & is Buried in an unknown, as yet, Cemetery.

FACT TWO: His son Robert Walkup NEELY was born in February 1831 in Warren (now Cannon) Co., TN. & married his 1st cousin Laura A. NEELY on August 25th, 1859 in Cannon Co., TN. & he died on January 31st, 1910 in Rutherford Co., TN. & is Buried in an unknown, as yet, Cemetery.
