Emma F. Allen was never married to Henry Franklin Foster. They had one son, Henry F. Allen, who was raised by his grandparents, Samuel Chandler Allen and Phidelia (Tenney) Allen.

Machias Union newspaper, 16 January 1872, page 2 column 3: "Emma F. Allen vs. Henry F. Foster; action to compel the alleged father to support an illegitimate child."

Defendant plead "not guilty," saying that he was not the father of said child, and never had but slight acquaintance with complainant.
Complainant testified that respondent seduced her by promising marriage. On second day of the trial some of defendants letters were read, which so far substantiated her testimony that respondent submitted to a default and a specified sum was agreed to be paid by him. F.C. Emma F. Allen sued Henry F. Foster for the support of a child (Machias Union newspaper, 16 January 1872). Henry F Allen was born 5 April 1871. Tradition says that her parents would not allow her to marry him. Common Pleas Court Records, Washington County for the period of 1870 to the April term of 1872, indicate a settlement was arrived at and recorded in Clerk's Docket #226 in the Log and #22-444 Folder. Excerpts are: One fourth part in common of the shingle mill owned by Henry F. Foster…located elsewhere in the county to said Emma F. Allen...free of all encumbrances…"

The Allen and Foster families have substantiated the facts down through the generations. Emma later married Warren Floyd, brother of Rollo Floyd of the famed Jaffa, Palestine expedition.
