Pvt Flanigan was 25 years old when he enlisted on 7/5/1861 at N.Y.C.. He was mustered in on 8/14/1861. On July 2, at Gettysburg,3rd Corps commander Daniel Sickles, positioned in a rather low spot along cemetery ridge and is not comfortable with the situation. He sees high ground in his front at and around the Emmitsburg Rd. (the infamous Peach Orchard and Wheatfield), and moves his men out. Alone and far out front, the blunder is not so soon realized by Sickles, though other commanders on the field are fairly dumbfounded by the move. Confederate General Longstreet (Lee's best corps commander) sees the opportunity and launches his first corps against Sickles. Hard fighting pushes Sickles back to more or less his original position with heavy losses. The 73rd N.Y. loses 33 killed and 43 wounded. Private Flanigan is among the dead. Dan Sickles would be severely wounded in the leg for his efforts. The leg was amputated and he donated it to the Smithsonian Institute at Wash. D.C.
