No. Most newspapers & funeral homes are forgiving when it comes to copying obits. And I don't think the Federal courts have ruled specifically on the copying of their obits. And that's only because neither have taken the matter to court. But if you look at the bottom of most online newspapers you'll see a "reserved copyright" notice. The wisest thing to do is ask for their permission and most of time they'll give it.

Your questions should be addressed to the administrators at F.A.G. Most obituaries are compiled either at funeral homes or newspapers by family members (from whom we also should seek permission before printing the full obit). Knowing a bit about the copyright law - one cannot copyright facts. But when you copy an item word-for-word, you are utilizing the creation of someone else. That is why you need their permission.

I have excerpted his obituary.. If you want me to transfer his memorial to you so that you can add the full obit., I will be happy to do so. However, F.A.G. regulations state that we should not copy full obits from newspapers or funeral homes without their permission.
