Hi, I live near Rehoboth Beach, grew up down here, and returned after hubby's military service was over.
I thank you for Lydia, I went there once and crops were growing and so put off til fields were tilled. I do have plans to go back in next week or so before crops come in again. She is a relative of mine, and so I do thank you for finding where she was as I had looked but not been able to find it myself.

Glad you get down here, is so relaxing with the salt air........

MILTON — The recent seizure of a family dog accused of attacking a neighbor and her dog has resulted in a lawsuit questioning whether Delaware Animal Care and Control officers have the authority to execute search and seizure warrants.

On March 16, John and Nancy Smith's dog Millie, a female, white-and-brown mixed-breed terrier, escaped from her leash outside their Milton-area home and got into a fight with a neighbor's male Yorkshire terrier. The Yorkie's owner also sustained an injury, court records state.

A few days later, a search warrant was executed by animal control officers, and Millie was seized as a potentially dangerous dog. The Smiths have been unable to visit or check on Millie – who is believed to be at First State Animal Center and SPCA in Kent County – since she was seized, said the Smiths' attorney John Brady.

“At the moment, the Smiths have not been able to have contact with Millie, and that will continue until the dog panel hearing,” Brady said last week. The dog panel hearing is scheduled for 7 p.m., Monday, April 13, at Sussex County Council chambers on The Circle in Georgetown.

Both the Smiths and the victim are under court order not to discuss the incident and pending case on social media, Brady said, and the Smiths are taking extra precautions by not conducting any interviews with local media since a gag order was issued April 2.

Prior to the court-ordered silence, John Smith, who co-hosts a weekend show on Delaware 105.9 FM, took advantage of a radio podcast with Dan Gaffney to outline the history of disagreements with his neighbors and the incident that led to the seizure of the family dog.

Smith said that on the day of the incident, he immediately made arrangements to pay the veterinary bills for his neighbor's injured Yorkshire terrier. He said he and his wife also offered to pay medical bills for their neighbor who, he said, also sustained injuries.

Soon after, he said, animal control became involved. He said the neighbor and DEACC officers brought up a 2012 incident in which Smith said Millie was attacked by another neighbor's Yorkie – a dog belonging to the mother of the neighbor involved in the March 16 incident, court records state. But instead, the argument was made that Millie was the aggressor, providing, according to Smith, a case against Millie that was not factual.

“My dog has never been aggressive toward another person,” Smith said in the podcast. “Others in the neighborhood love Millie. … These people have been out to get us.”

Because Millie bit a person, there is a 10-day quarantine process. The extensive injuries sustained by the male Yorkshire terrier led the DEACC to label Millie as a “dangerous or potentially dangerous dog,” court records state.

The Smiths also are facing criminal charges related to the incident. Both are facing one charge each of maintaining a dangerous animal; Nancy Smith was charged for a violation of the leash law; and John Smith is facing a charge of hindering prosecution, Brady said.

Just as courts have found sheriff's deputies do not have police powers, a Superior Court lawsuit filed by Brady argues that animal control officers have no power to apply for or execute warrants. The lawsuit also argues for the return of the “unlawfully seized dog” and for the court to prohibit the DEACC from applying for search and criminal warrants in Justice of the Peace Courts.

First State Animal Center and SPCA Executive Director Kevin Usilton and Delaware Animal Control Chief Capt. Sherri Warburton could not be reached for comment.

The Superior Court lawsuit is pending, the dog panel hearing will be held Monday, April 13, and the Smiths will be arraigned later this month, Brady said, which will be followed by a request for a jury trial

Hi Mark,

Thanks once again for the pictures. I was really looking forward to William Solotarevsky photo, but it was a huge disappointment - no Hebrew text. Could you please confirm that there was no Hebrew text whatsoever on his stone? If not, it basically means that I'll never know his father's name - his death certificate doesn't list it.

Also, I have another question. When you go to Har Nebo, is there anyone in the office? The reason I am asking is that this is the only cemetery which wouldn't just give me the burial location. I was able to get it for William, but since then they implemented a ridiculous $100 genealogical fee. Obviously very few people would pay $100 for a burial location. He did tell me on the phone back then that he's sick and tired of genealogical requests, so he clearly implemented it to push people away. Anyway, I have other Har Nebo memorials I am very much interested in, but I don't know the burial location. I'd be interested to hear your thoughts about it.

Once again, really appreciate your work.

Ty for finding my Great grand parents grave sites I am so grateful to you. The cemetery said they didn't have a grave stone. So I gave up. So I just left it to the Lord. It's in his time not mine.
