Captain Burleson died instantly after being shot twice by Mr. Foltz, a German, seven miles from Lockhart. After the shooting Foltz gave himself up.
Captain Burleson was married to Eleanor E. Baughn. During the Civil War Captain Burleson was a member of the 36th Texas Cavalry led by Colonel Peter C. Woods.

Joseph Rogers Burleson (September 20, 1830 – May 29, 1889) served as Hays County Sheriff on four separate occasions as Hays County Sheriff. First term August 1852 – August 1854; second term July 1860 – October 1861; third term August 1864 – October 1865; and fourth term April 1865 – February 1870. Sheriff Burleson was the son of General Edward Burleson. Sheriff Burleson also served as a Hays County Commissioner for 9 years and in the Confederate States Army as a Captain in the 36th Texas Cavalry led by Colonel Peter C. Woods. At the time of his death, he was the First President of the Hays County Farmers Alliance. Sheriff Burleson was killed on April 5, 1889 after being shot twice by Mr. Foltz, a German, seven miles from Lockhart, Texas. After the shooting, Foltz gave himself up.
