Died 14 Oct 1863. Killed in action at the Battle of Bristoe Station. Attached to Companies F & S of the 42nd New York Infantry Regiment. Colonel, Brevetted Brigadier General.

Cited for bravery at the battle of Antietam, MD, where he retrieved his regiment's fallen flag from between the lines under fire. Commanded the 42nd New York Infantry Regiment at Gettysburg, PA, leading his regiment to counter-attack and help stop the Confederates of General Pickett's Charge on July 3, 1863. In command of the Third Brigade, Second Division of General Gouvenuer K. Warren's Second Corps, Army of the Potomac, at Bristoe Station, VA, when he was killed.
