Waldemar Rivera, who admitted he threw the punch that killed fellow inmate Kevin Cales in prison more than a year ago, was sentenced to 10 years in prison today in Superior Court.
Rivera, 30, pleaded guilty to first-degree manslaughter in December. He was serving a seven-year prison term for robbery when he punched and killed 34-year-old Kevin Cales at McDougall-Walker Correctional Institution in Suffield on May 13, 2008. Cales died hours later at St. Francis Hospital and Medical Center in Hartford. It was the punch that killed him, Rivera's public defenders have said.
Judge David P. Gold said the 10-year sentence will run consecutive to the seven-year robbery sentence Rivera is currently serving.
Investigators learned that Rivera was a cousin of Maryneliz Jimenez, who died along with four of her friends in a 2006 Berlin crash that happened during a car chase with Cales, her ex-boyfriend. Rivera learned of her death almost two years after the fact. Cales had served less than two months of his 79-year sentence for manslaughter at the time of his death.
Rivera originally was charged with murder in what prosecutors described as a revenge killing. But they reduced the charge to manslaughter, saying they could not prove Rivera meant for Cales to die.
Cales was convicted of causing the five deaths when he chased a car driven by Jimenez, 21, his ex-girlfriend and the mother of his child, on Chamberlain Highway in Berlin on May 27, 2006. As Cales approached the Honda Jimenez was driving, Cales said, "I got her now, I got her now," according to court records.
But Jimenez's car spun off the road. Cales backed up at high speed and lost control of his car, which rolled over into the woods. Cales and his two passengers left the scene.
