Jacob Justice appears to be the son of Joseph J Justice and Nancy Lee Eller. He was born in Buncombe County, NC but eventually lived in Bee Log, Yancey County, NC.

Jacob is a brother to James N. Justice, John Justice, Nicholas Justice, William Joseph Justice, Gregg Justice, Sophronia Jane Justice, and Elizabeth Justice. He served in Co K, NC 25th Infantry from July 1861 to Dec 1864. He was wounded at Sharpesburg, MD 9-17-1862. He was again wounded at Plymouth, NC in April 18-20, 1864. Jacob was listed as present through Dec. 1863. He was listed as a deserter and dropped from the rolls 12-31-1864.

Buncombe County, NC marriage records state that Jacob Jestes married Rebecca Roberts on 11-15-1859. They are the parents of Eliza B. Justice Howell, Bathilda M. (possibly Martha) Justice, Mary K. Justice, Suellen Justice, Deborah Vasta Justice Lewis, Linda Jane Justice Tipton, and Idia Justice.

In 1870 he and his wife are rearing their children and the two children, Nancy and Lewis, of his brother, Nicholas, following Nicholas' death after the war.

In 1880 he was noted as married but living in the household of Isom and Naomi Fender. It was also noted that he was "insane", but instead he had suffered from two strokes according to hospital records.

His daughter, Eliza, would die in 1935 in a "railroad accident, hit by a train while walking across the bridge". Possibly the trestle that crosses the Nolichucky River that goes into Unaka Springs.
