His parents were not married.

Margaret Hays
Margaret Hays was my great great great grandmother. When she left Alabama she was with my great great great grandfather Alexander Whaley. They had to leave Alabama because Alexander was legally married to someone else. In those days they would be breaking the law so they had to go somewhere else where they stood live and not be in trouble. First Tennessee according to census records from 1850 Poinsett County Arkansas. The first two children they had together we're born in Tennessee. And they move to Arkansas. Their son Riley was my great great grandfather supposedly Alexander and Margaret had a wedding ceremony Arkansas to convince people they were married but the marriage was not legal and in 1863 when Alexander died his pension from the war of 1812 went to his legal wife Ruth in Alabama. She lived to be a hundred years old dying weeks before for 101 first birthday in 1887.
