In 1946, Norbert J. Muggli joined the firm, changing the Firm's name to Mackoff, Kellogg and Muggli. Five years later Ward M. Kirby's arrival resulted in the Firm being known as Mackoff, Kellogg, Muggli and Kirby. It remained so until Muggli became district judge in 1965. By then, Paul G. Kloster had been with the firm for 6 years. When the firm incorporated, its name was changed to Mackoff, Kellogg, Kirby and Kloster, P.C.. Muggli retired as district judge in 1981 and died in 1998. Kirby, who remained with the firm until his retirement in 1989, passed away in 1993. In 1998 the firm licensed its present name: Mackoff Kellogg Law Firm.

Ward M. Kirby, 71, Dickinson, died Sunday October 3, 1993. Funeral services will be held Wednesday October 6, at 11 a.m. at the United Methodist Church in Dickinson with the Rev. Randy Atherton officiating. Special music will be provided by Betty Jo Todd, soloist and Robyn Nadvornik, organist. Burial will be held in the Dickinson Cemetery with military rites provided by the Veterans Drill team.
Visitation will be held at Price-Gaffaney Funeral Home Tuesday from 9 a.m. to 9 p.m. and will continue Wednesday at the church for one hour prior to the service.
Ward M. Kirby was born May 21, 1922, in Mandan, a son of Eugene and Gertrude (Alderin) Kirby. He grew up in Hazen and graduated from Hazen High School in 1939. He served in the United States Air Force for five years. On June 10, 1947, he married Virginia Barney in Grand Forks. He attended and graduated from the University of North Dakota and went on to attend the University of North Dakota Law School, where he was a member of the Law Review and graduated Order of the Coif. He was a teaching fellow at New York University before returning to North Dakota to join the Mackoff, Kellogg Law Firm in Dickinson. He practiced law with the firm until his retirement in 1987.
He was a past president of North Dakota State Bar Association and past Grand Master of North Dakota Masonic Grand Lodge. He was also a member of the Elk's, Shriners, German Hungarian, Rangers, and District Chairman North Dakota Republican Party.
He is survived by his wife, Virginia of Dickinson; a son, Jeffrey (Sylvia) of Dickinson; three daughters, Laurie (Earl Pomeroy) Kirby of Washington, D.C., Jan Bjornson and Kristi (Don) Rasmussen, all of Dickinson; six grandchildren; three sisters, Bette Holmquist of Benson, Minn., Jeannette Kirby of Minneapolis, Minn., and Ruth Williams of St. Joseph, MO.
He was preceded in death by his parents, a sister and a daughter.
