Elias Day was a Presbyterian Minister in Wayne Co., Penn. Was of Pennsylvania in 1820, Ohio in 1830 through 1840, Justice of the Peace in Union Township, Clermont Co., Ohio in 1847. Still in Ohio in 1850 Census. Is listed as a passanger to Calif. in 1852 in San Francisco, Calif., back in Ohio, Knox Co., Jefferson Twp. in the 1860 Census and is Retired. Left again for Calif. on April 25, 1870.

From the Russian River Flag - Nov. 20, 1873 - Probate Notice.
"State of California, County of Sonoma. In Probate Court. In the Matter of the Estate of Elias Day, deceased. Notice for publication of time oppointed for proving Will, etc. - PURSUANT TO AN ORDER OF SAID court, rule on the 19th day of November, A. D. 1973, notice is hereby given, that Monday, the 15th day of December, A. D. 1873, at 10 o'clock A. M. of said day, at the Court Room of said Court, at the City of Santa Rosa, in the county of Sonoma, have been appointed as the time and place for proving the Will of said Elias Day, deceased, and for hearing the application of Stephen Day and William McElroy for the issuance to them of Letters Testamentary, when and where any person interested may appear and contest the same.
Given under my hand and the seal of said Court, this 19th day of November, 1873 - WM. R. MORRIS, Clerk, by GEO. P. NOONAN. Deputy Clerk. H. C. Firebaugh, Attorney."

"From the Sonoma Democrat of the 20th inst. we learn that the will of J.(?) Elias Day, of Healdsburg, has been filed. He bequeaths to Elizabeth M. McElroy one-half interest in the farm owned jointly by Wm. McElroy and testator, provided that the said Eliza M. McElroy shall, within six months, pay to Louisa Renfro one hundred dollars, and to Loretta Lewis fifty dollars; to Louisa Renfro a certain promissory note for $300; to Lorreta Lewis a certain promissory note for $50; to Stephen Day all the residue of estate, on the payment by him within six months of $500 to Elias Edwin Day, and $100 to Damras Shrimplin. Stephen Day of the State of Kansas and Wm. McElroy of Sonoma county are nominated executors, without bonds."
