Paynie Burgess, 54 of the 8th district, is under charges of slaying Virgil Campbell, 36, Cookeville taxi driver, Sunday morning near the Burgess school house and close to the spot where Campbell was alleged to have killed Burgess' son, Ridley, last fall.
Campbell was shot from ambush while driving his car on a lonely country road near Burgess' home, the discharge of buckshot from a shot gun tearing a hole through his car door and taking effect in his side.
He died Sunday afternoon in the City hospital.
Sheriff Burton said an eyewitness, Estes Howell, who was riding with Campbell, declared he saw Burgess fire the shotgun from a clump of bushes near the side of the road. Howell jumped from the car and ran.
Burgess said he was at home at the time of the killing and that his claim could be substantiated by his wife. Burgess was formerly a U S prohibition posseman.
He was arrested late Sunday night on a warrant charging murder sworn out by Campbell's brother, Charlie.
Campbell was found unconscious in his car about 11:30 a.m. and was rushed to the City hospital where he died a few hours later.
