David Baker was killed by Richard Marshall and arrested by Smith Jackson. Richard Marshall went to prison for the murder. When he was released from prison, he threatened to kill Smith Jackson. Smith Jackson killed Richard Marshall in 1867. The trial was held Aug. 7, 1867 and Smith Jackson was acquitted on grounds of justifiable homicide for he was in fear of his life.
