John Mathew McGrath was the son of John McGrath (1830-1902), and Katherine Hennesy (1837-?), both from Ireland. He was elected Judge of the Criminal Court of Mercer County, West Virginia, in 1894. According to his biography, he was married to Nannie Jackson McCreery in 1899.
"This picture of the late Judge M. McGrath, who was Judge of the Criminal Court of Mercer County at the time of his death, was made in front of the Darst House which many years ago stood on the corner of North Walker Street and Honaker Avenue, where the Pure Oil filling station now stands. The picture shows Judge McGrath facing toward the present Courthouse. This picture is the property of James Harold Martin, Attorney, and is loaned to the Office of the Clerk of Criminal and Circuit Courts of Mercer County, and is to be returned to me upon request. J.H.
