James was the son of Captain Joseph Marcum Kirk of the 39th KY Regt (Union) and his wife Nancy Dingiss Kirk. James was a Sgt in the same Regiment, Company I, which fought at the Battle of Salyersville, Battle of Saltville, & the Second Battle of Saltville.
He became a man of some substance in Martin County.
