Charles R. Petree II | 1933-2012: Judge remembered as gentleman

Judge Charles R. Petree II, who held elected positions for parts of five decades, died Sunday at 78.

Charles R. Petree II, whose public-service career began with three terms on Columbus City Council and ended with three terms as a Franklin County Court of Appeals judge, died on Sunday at his home in Columbus.

He was 78 years old and held elected offices for portions of five decades.

"Above all, he was a gentleman," said William Newcomb Jr., a retired Columbus lawyer who knew Petree for more than 30 years. "That carried through from his private practice and as a judge. He had a wonderful judicial temperament."

Petree was a judge of the Franklin County Municipal Court from 1983 to 1984, Domestic Relations and Juvenile Court from 1984 to 1990, and Appeals Court from 1991 to 2009.

County Prosecutor Ron O'Brien recalled being the city prosecutor when Petree first took the Municipal Court bench.

"He was a great example of a diligent judge and was interested in the many persons that appear daily in that court," O'Brien said. "Later, it was an honor to argue cases before him when he served on the Court of Appeals."

Petree was a city council member from 1968 to 1979 while also working as a lawyer in private practice. When he decided not to seek a fourth term on the council, he told The Dispatch he was pleased that, through his work on the zoning committee, he had a role in guiding the city's growth in the 1970s.

He then followed in the footsteps of his father, who had served as a Municipal and Appeals Court judge.

In seeking what would be his last term on the bench, Petree, a Republican, said he was proud that he was never labeled a conservative or a liberal because he decided each case based on the facts and the law.

Appeals Court Judge William A. Klatt was serving his first term on the bench when Petree was in his last.

"He was very helpful and very supportive as I was getting acclimated," Klatt said. "He left a legacy of common sense, collegiality and practical problem-solving. He was a real gentleman as a colleague."

Petree was born in Columbus in 1933 and graduated from North High School. He earned his undergraduate and law degrees from Ohio State University. He was a veteran of the U.S. Air Force and the Air Force Reserves.

He is survived by his wife of 34 years, Carolyn, six children, five grandchildren and two great-grandchildren.

A memorial service will be held at 10 a.m. Thursday at Trinity Episcopal Church, 125 E. Broad St.
