Born in a log cabin located along German Road in Greenfield Township, Erie County, Pennsylvania. Graduated from the Lake Shore Seminary (a residential high school) in the Borough of North East, Erie County, Pennsylvania in 1875. Emory paid his way thru the Lake Shore Seminary by working as a janitor at the school. Attended Edinboro State Normal School (now called Edinboro University) located in Edinboro, Erie County, Pennsylvania for one year. Apprenticed to be a lawyer beginning in 1876 under Attorney William Benson (who he named his firstborn son after) and was admitted to the practice of law in Erie County, Pennsylvania in 1878. Erie County, Pennsylvania District Attorney from 1881 to 1884. Pennsylvania State Senator from 1885 to 1888. President Judge of the Court of Common Pleas of the Sixth Judicial District of Pennsylvania composed of the County of Erie from 1897 to 1915. Judge of the Supreme Court of the Commonwealth of Pennsylvania from 1916 until his death in 1931.
