Be it remembered that, on the 18th day of March, AD 1862, the last will and testament of Samuel Helvie, deceased, late of Clark County, Ohio, was produced in court by Wiley Jenkins, the executor therein named, duly probated and authenticated by the Probate Court of Clark County, Ohio and said will relating to lands in the County of Champaign in the State of Ohio, ordered that said will and probate be recorded.

The will and probate is in the following words and figures to wit:
The State of Ohio, Clark County:
Be it remembered that heretofore to wit on the 23rd day of April AD 1862, the last will and testament of Samuel Helvie, late of said County deceased, was produced for probate by Wiley Jenkins, the executor named in said will. Said will is in the following words and figures to wit:

In the name of the Benevolent Father of all, I, Samuel Helvie, of the County of Clark and State of Ohio, being weak in body but sound and disposing mind and memory, do hereby make and publish this my last will and testament in form and manner following to wit:
Item 1st: It is my will that all my just debts and funeral expenses be paid out of my estate after my decease.
Item 2nd: I give and bequeath to my beloved wife, Margaret, seventy(70) acres of land being the south part of the NE quarter of Sec. No. 23, T3 MRS, also four acres of land to be laid off in a square in the NE corner of the NW quarter of said Section No. 23, to have and to hold the same in lieu of her dower in my real estate during her natural life, also two work horses, two cows, ten head of sheep, six hogs, two beds, (unreadable) and bedding and so much kitchen furniture as she may see proper to select from what is on hand at my decease. Also the sum of two hundred dollars in money which articles shall be in lieu of what her lawful share would be out of the personal property. It is my will and I hereby direct that my executor herein after appointed shall appropriate sufficient money out of my estate to build a comfortable frame house and stable on said seventy acres tract. Said house to be made of such size and dimensions as will be suitable for her, my said wife, and children, which said executor shall be the judge thereof.
Item 3rd: It is my will and I hereby bequeath to each of my several children, the balance or residue of my estate after paying the debts, expenses and legacies herein before mentioned, share and share alike, with the exception of the share of my daughter, Margaret, late Margaret Meranda, dec., which share is to be divided as follows, viz: She having died leaving two children, Mary and Samuel. It is my will and I hereby direct that the said Mary shall receive out of said share the sum of twenty(20) dollars and the said Samuel the balance of said share provided he, the said Samuel, shall live with and perform labour for my said wife until he shall arrive at the age of twenty years, if not, there a deduction to be made as shall seem reasonable and just.
Item 4th: I have heretofore given as advance to my son, William Helvie, the sum of four hundred and thirty six(436) dollars; to my daughter, Nancy, the sum of four hundred thirty six(436) dollars and to my daughter, Elizabeth, the sum of two hundred and eight six(286) dollars, which said advances are to be deducted out of their shares.
Item 5th: It is my will and I hereby direct that the farming on my several farms shall go on as commenced until next fall, at which time, my executor shall sell at public sale, all the personal property not herein disposed of, it is my will that the beds, bedsteads and bedding not herein disposed of, shall be equally divided between my five youngest children. I have advanced to my son, James Helvie, the sum of eight six(86) dollars which is to be accounted for out of his share.
Item 6th: It is my will and I hereby direct my executor herein after appointed shall sell at public or private sale, all of my real estate not herein before disposed of and upon such items of credit as he may deem best so as to bring the best possible price or prices, bot not to force it off what in what is denominated hard or dull times, and until the same is sold, he shall take charge of said farms, keep in repair and rent the same to the best advantage.
Item 7th: I hereby nominate and appoint my friend, Wiley Jenkins, of Pike Township in Clark County, Ohio, my executor of this my last will and testament, giving and confering upon him full powers and authority to carry out the provisions of the same. On testamony whereof, I, the said Samuel Helvie, the testator, have hereunto set my hand and seal, April 15, 1862.
