"Divorce Granted 21 Years Ago Set Aside"
Decree Given Lon Derosett in 1931, But Records Show He Was Adjudged Insane In 1928:
A divorce decree obtained 21 years ago by Lon Derosett of Carthage from Maude Derosett was set aside yesterday by Judge Walter E. Bailey in an unusual proceeding in division No. 1 of circuit court.
Derosett, a farmer, died a few years ago and Mrs. Derosett still resides near Carthage.
It is understood that this divorce was nullified with settlement of his estate....
The Derosett's were married in 1904 and...he obtained a divorce April 16, 1931 on the grounds of abandonment.
However, it was brought out, Derosett in 1928 was adjudged insane in Douglas county court in Nebraska and sent to a veterans' hospital for treatment.
He never was adjudged sane again, insofar as records show, and an insane person can not initiate and obtain a divorce.
While the decree he obtained in 1931 was illegal, Mrs. Derosett...did not learn about it until years later and then was afraid to bring court action to set the decree aside.
The situation remained status quo until after his death. When proof was made to Judge Baily...that Derosett had not been officially judged sane at the time he obtained the divorce, the court entered an order setting the original decree aside.
The clerk had to dig back through old records to find the original records and nullify the divorce."
