Last will of Benjamin R. Nodine Deceased transcription:
I Benjamin R. Nodine of Fremont Township, Steuben County Indiana, being of sound mind, make this my last will.
I give, devise, and bequeath my estate and property real and personal as follows, that is to say:
All I may die possessed of both personal and real property, after my just debts are paid I give and devise as follows,
1st To my wife Julana I give the use of all I die possessed of during her life time, (after my debts are paid) to have and to hold the same, for her own use and enjoyment, with power to sell personal property should it be necessary to pay any outstanding debts against me at my death, and at the death of my said wife, then the said property personal and real to be divided as follows –
2nd To my daughter Mary Nodine is to be given the sum of ten dollars –
3rd To my daughter Emily Brown is to be given the sum of ten dollars –
4th After the above amounts are paid to my daughters Mary and Emily, the balance of the property both personal and real is to be divided equally between my two sons, James Nodine and Benjamin F. Nodine, should they both be living at the time of the death of my wife Julana but should either have died before my said wife, then the share that would be going to him, if living, is to go to his heirs, and in case he should have no heirs, then the amount that would be going to him if living is to go to my surviving son or his heirs – I hereby revoke all former wills by me made –
In witness whereof I have signed and sealed and published and declared this instrument as my will at my residence in Fremont Township Steuben County, Indiana, on this Eleventh day of November one thousand eight hundred and eighty – [signed] Benjamin R. Nodine –
The said Benjamin R. Nodine at his residence in Fremont Township, Steuben County Indiana on the 11th day of November 1880, signed and sealed this instrument and published and declared the same as and for his last will, and we at his request and in his presence and in the presence of each other have hereunto written our names as subscribing witnesses – [signed] Emory G. Melendy
