Benjamin enlisted in the 39th Regiment Massachusetts Volunteer Infantry. Co. C. on August 14, 1862. He as part of Co. C. was sent to Lynnfield, MA and later Camp Stanton, Boxford for basic training. The regiment was under the command of Col. P. Stearns Davis. Arriving in Washington, D. C. on Sept. 8th, the 39th was sent to camp on Arlington Heights and became part of Briggs Brigade of Casey's Division of Reserves. During the autumn of 1862 the 39th was sent to guard the north bank of the Potomac River between Senaca Creek and Conrad's Ferry. Winter camp was established at Poolesville, MD where the regiment remained until April 1863 when the 39th was sent to Washington performing guard duty until after the battle of Gettysburg later that July. On July 12th the 39th was assigned to the Army of the Potomac at Funkstown, MD and was transferred to Rappahannock Station as part of Coulter's Brigade. Due to illness,Benjamin Merritt was sent to Washington to one of the many military hospitals in the capital. He was discharged for disability on August 21, 1863 in Washington. He returned to Scituate and at the age of 79 died on February 15, 1901.
