Born in Grant Co. Ky. s of William McMurtry & Sallie Ann VanDeren, brother of Josephus; Effie Jane; William Lewis; Robert Roscoe; David Caldwell & Alfred VanDeren McMurtry.

James attended common schools in Grant & Harrison Counties and Smith's Classical School of Cynthiana. He married his first wife Dec 17, 1902 Lucy Wood Allen (b Apr 10, 1881 Harrison Co. Ky died Apr 19, 1921 dau of Garnett Wood Allen & Almira Potts), and had two daughters, Margaret Allen McMurtry & Elizabeth Allen McMurtry . James later married Nov 29, 1922 Teressa (Lee) Parrish (later div).

James with his brother, Josephus, operated a Livery, Feed, and Sale Stable during horse and buggy days. Horses were also boarded at the McMurtry Livery Stable.

James was very active in the affairs of the Cynthiana Baptist Church, served as Deacon and Sunday School superintendent.
