Death: Jul. 22, 1938

Ben Hunter was shot by my great uncle, Edward Oakley Burt at approx. 12:25 a.m. Friday morning, July 22, 1938 at the home of Mr. and Mrs. Fred Coleman, just outside of Londonderry, Ohio (Liberty Township, Ross County). He was taken to the office of Dr. Ovid Owen Burt in Londondery by Mr. Ray Swaney, arriving at approx. 12:50 a.m. Ben died in Dr. Burt's home/office at 1:15 a.m July 22, 1938. Dr. O.O. Burt was my Grandmother's first cousin, and Edward Oakley Burt was her half brother.

Edward Burt was charged, arrested and arraigned for 1st degree premeditated murder on Wednesday July, 27, 1938 and held without bail in the Ross County Jail until the Grand Jury convened in October 1938. The Grand Jury indicted Edward in October 1938 of 1st degree murder, and he was held without bail until his trial began December 5, 1938.

On December 9, 1938, Edward was found guilty of Manslaughter by the Jury. Judge W. M. McKenzie sentenced Edward to not less than one, nor more than twenty years in the Ohio State Penitentiary on December 17, 1938.

God Rest You Mr. Hunter. It Is Not My Place To Pass Judgement On You Nor Ed, That Is Between You And God. I Am Sorry That You Lost Your Life At The Hands Of One Of My Relatives.
