Tom Gay, 86 year old father of Harper Gay, was freed of murder charges in a commitment hearing held at the Spalding County Courthouse today.
Gay and his son have been held in the county jail since March 31 in connection with the slaying of Ernest B. Boynton, a 70-year old neighbor in Sunny Side.
Murder warrants were taken for both men following the slaying and they were held in the jail.
Mrs. Ira Greer, justice of the peace of Experiment District, presided at the hearing today and told the 86-year-old man that he was "free and could go where he pleases" at the end of the hearing.
Solicitor General Jack Flynt told the court that there was no evidence connecting the elderly man with the slaying and he had been told shortly after hewas imprisoned that he would be freed. A commitment trial was necessary to rid the man of the murder charges, Flynt said.
