Newspaperman, lawyer and at one time president of the Texas senate. He made many enemies, among them Albert B. Fall and politician Oliver Lee. He was appointed to serve as legal representation for Billy the Kid in his trial for the murder of Sheriff William Brady. Fountain lost this case, and Billy the Kid was sentenced to death. In 1896 Fountain and his eight-year old son were returning from a court session in Lincoln, New Mexico, when they disappeared without a trace. Oliver Lee; his foreman, Jim Gililland; and Bill McNew were tried for murder but acquitted.
