Foote was a US Senator from 1847 to 1852, resigning to serve as the governor of Mississippi. In 1854, he lost an election to return to the US Senate by one vote. Moving to California, he lost an 1856 run for the US Senate there, again, by one vote. During the Civil War, he was the Representative from Tennessee in the Confederate Congress. In early 1865, he was expelled from the CSA Congress for going North on an unauthorized peace mission.
