Upon the pleadings and proof and especially on the Report of the Clerk and Master, which report is as follows:

Report of Clerk and Master on Order of Reference
I) Elizabeth Henry died in Sevier County, Tenn, about July 14th. 1927 intestate.

II) Elizabeth Henry died the owner of a tract of about 3 acres of land in the lst District of Sevier County, Tenn., with a dwelling house, small store building, a young orchard and garden and well thereon, which is unincumbered.

III) Elizabeth Henry left no children surviving her. She left one sister Julia Gunter, and a nephew Reuben, son of her deceased sister JANE MC INTOSH, surviving her and as her only heirs at law.

IV) The place is so small it could not be advantageously partitioned in kind, but would be to the manifest interest of both the heirs to sell same for division.

And said report being unexcepted to, is in all things confirmed by the court.

II) And the court being satisfied that the facts are as set out in said report, the respective rights and interests of the parties are adjuged and settled accordingly, the share of each being as reported by the Master.

III) It is therefore ordered, adjudged and decreed by the court, that said tract or parcel of land be sold for partition, and that the Clerk and Master sell the same according to law, after advertising by written posters onl, requiring one third of the purchase price to be paid in cash, and the remainder on six and twelve months time. He will take notes on deferred payments, with personal security drawing interest from date, and retaining a lien on the land for further security.

Said land is bounded as follows: By Huff, Williams, Huff and perhaps others, containing 3 acres more or less.

This indenture, made the 7th day of January, 1929 between A. H. LOVE Clerk and Master of the Chancery Court at Sevierville, for Sevier County, Tennessee, of the first part, and REUBEN MC INTOSH of Sevier County, State of Tennessee of the second part. Witnesseth, that by a decree of said Court rendered at the Dec Adj Term, 1927 in the cause of Julia Gunter et vir Complainant, and Reuben McIntosh, et al Defendant and entered on page 222 of Minute Book I (i) the said Clerk and Master did on the 7th of January 1928 sell at public auction the real estate hereinafter described, to the said REUBEN MC INTOSH for TWO HUNDRED AND FIFTEEN DOLLARS, as appears from the report of said Clerk and Master, made in said cause to the Feburary Adj Term, 1928, and entered on page 251 of Minute Book I (i) and the said REUBEN MC INTOSH having paid said sum of Two hundred and fifteen dollars, as required by the decree of said Court confirming said report:

Now, therefore, in order to carry into effect said sale, in pursuance of said decree, and in consideration of the sum of Two hundred and fifteen ($215.00) dollars, paid to said Clerk and Master, the receipt of which is hereby acknowledged, the said A. H. Love as such Clerk and Master, doth hereby transfer and convey to the said REUBEN MC INTOSH and his heirs and assigns forever, said tract or parcel of land, situated in the County of Sevier, and State of Tennessee, and bounded and described as follows, viz:

One tract of land containing about 3 acres, more or less lying and being in the First Civil District of Sevier County, Tennessee and known as the ELIZABETH HENRY land is adjoined by the lands of Williams, Webb, Huff and others.

To have and to hold said real estate, with all the hereditaments and appurtenances thereto belonging, to the said Reuben McIntosh and to his heirs and assigns forever.

In witness whereof, the said A. H. Love Clerk and Master as aforesaid, hath hereunto set his hand the date first above written.

II) That the heirs at law and next of kin of the deceased are:
