Son of Giles Delay and Sarah (Sally) Short. Grandson of Lt. James Delay of Ireland who served in the Light Infantry of the North Carolina Militia, during the American Revolution.
Husband of Harriet Cooper (daughter of Cannady/Kennedy Cooper and Susannah Keesie). James and Harriet were married 1843 in Johnson County, Arkansas.
Father of; Julia Ann (1844-1924), John Kennedy (1849-1932), Susan E. (1852), James H. (1853-Aft 1900), Burgess 'Bird' (1855-1877), Orville P. (1857-1927), Harriet A. (1860-1862) and Gideon 'Gid' Wilson Delay (1863-1930).
James Calvin DeLay, served during the Civil War, first in the 9th Texas Calvary Co. K and the 25th TX Calvary Co. E., with his brother-in-law James Cooper. He was a grandfather to Arizona DeLay. He is noted as part of a Listing of Males Eligible to Service as; "Delay, Jas., Fannin Co, age 35, born 1825 in TN."
2 Sgt. James Delay, Army of Tennessee, 25th Regiment Texas Calvary, Co. E., . Hill's Corp., Cleburne's Division, Deshler Brigade, Hardee Corp. Battle flag. He is also listed as having initially served for a brief time as a Sgt., in Co. K, 9th Regiment Texas Calvary. The 9th Texas Calvary is listed as being organized from men of Lamar and Red River counties. He enlisted March 20, 1862. The 25th was organized with about 900 men and had 552 in action at Arkansas Post.
At some time in 1862, James DeLay transferred to the 25th Texas Calvary. Regimental history noted as; The 25th Texas Calvary Regiment (also called the 3rd Texas Lancers) was organized by C.C. Gillespie early in 1862. The unit was soon dismounted and ordered to Arkansas. Sgt. DeLay and the 25th saw action in the engagement at Fort Hindman, Arkansas and were captured January 11, 1863 at Arkansas Post. Following the prisoner exchange at City Point, Virginia, the regiment was consolidated with the 17th, 18th, and 24th Texas Calvary Regiments (dismounted) and was placed in Deshler's, J.A. Smith's and Grandbury's Brigade, Army of Tennessee.
The command fought with the army from Chickamauga to Atlanta, moved with Gen. John Bell Hood to Tennessee, and saw action in North Carolina.
At the Battle of Chickamauga, the 17th, 18th, 24th and 25th suffered 200 casualties.
It was during the battle of Chickamauga, James Delay was killed on the battlefield, on 20 September 1863. His remains, and those of his commrades lost during this battle, are listed as transfered for burial in the Marietta Confederate Cemetery. His name has not been included in the cemetery roster, and is likely registered only as a number or in a mass grave.
