At one point during the Civil War, Bas acted as a scout for Captain Timothy Lyons, Union Officer, as Lyons led a raid on Robbinsville and surrounding areas in 1864. It is believed that Bas was not under military command at that time. Two of his sons had just been killed by John Jackson Kirkland's guerrilla group known as the Kirkland Raiders. Ironically, the sons, Jim and Jeff, of the llth Tennessee Calvary, Union Volunteers, were John Kirkland's 1st cousins.

On December 7, 1864, Bas and his 17 year old son Joe Berry were captured with several others by Captain W. R. Abbot, CSA, at Little Toqua Creek in Monroe County, TN, during a roundup of the opposition. Because of his youth, Joe Berry was released, but Bas and the others were soon enroute to Asheville, NC. Soon after leaving from the Hardin Farm, which is now the site of Calderwood, TN, where the group had camped for the night, Bas was shot by the Rebels, for some unknown reason, and left in a low gap on the Old Tennessee Turnpike at the Big Poplar Turn on Highway 129. His grave is about 6 1/2 miles from Deal's Gap on the Tennessee side,just a short distance from the highway.Gravesite located near the northern Horn MileMarker # 6.5 on The Dragon's Tail, on Highway 129 in Tennessee. Shaw was buried after being killed by Confederates as he was transported to prision.

The infamous Kirkland Gang ( Kirkland Bushwackers) was led by John Jackson Kirkland, Bas Shaw was John's uncle by marriage.Bas's wife and John's mothers were sisters. His tombstone declairs his death by rebel soldiers . Some say it was his nephew John who killed him as well as his two sons who were enlisted in the union army.
