The son of John Burgess Sr and Jane (Macklefresh) Burgess of Anne Arundel Co MD, Joseph married Elizabeth Dorsey on 13 Jun 1751 in Anne Arundel Co MD. Elizabeth is the daughter of Michael Dorsey and Ruth (Todd) Dorsey.

Joseph was baptized on 27 Jun 1727 at All Hallows Parish in Anne Arundel Co MD. He witnessed the Wills of both John King in 1790 and John Osbourn in 1739. Joseph's Will is dated 9 Sep 1805 in Anne Arundel Co MD. His estate was Probated on 19 May 1806, also in Anne Arundel Co MD.

Enlisting in the Revolutionary War 10 Dec 1776, Joseph commanded a company of Elk Ridge Militia and was also a part of the 3rd Battalion, MD Flying Camp. It was ordered on 4 Mar 1777, the Western Shore Treasurer pay Captain Joseph Burgess, one thousand dollars for recruiting service.

He subscribed to an Oath of Allegiance to the State of MD on 12 Mar 1778, before Magistrate John Dorsey. For his military service, land was given him near Fort Cumberland MD. Six of Joseph's sons also served in the Revolutionary War.
