He was a Confederate veteran, having enlisted in Simpson County on 30 April 1862. He served as Second Lieutenant in Company B of the 16th Mississippi Infantry and as Captain of Company F (Pearl River Guards) of the 39th Mississippi Infantry, Confederate States Army. His command post was captured at Port Hudson, but he managed to escape and reported back to his command after a short period of duty with General Joseph E. Johnston. He was surrendered at Citronelle, Alabama on 4 May 1865 by General R. Taylor, CSA, to Major General Canby, USA, and was paroled at Jackson, Mississippi on 20 May 1865.
Captain Banks was the sheriff and tax collector of Simpson County for several years. He was a prominent Mason and a member of Westville Baptist Church.
