Benjamin McCarty was born December 22, 1759, in Frederick County, Virginia, son of Darby McCarty and Hannah Richardson.

On August 20, 1778, in Shenandoah County, Virginia, Benjamin married Sarah Conner. Benjamin and Sarah ultimately would have nine known children: Enoch McCarty, Nancy McCarty, Lydia McCarty, Elizabeth Sarah McCarty, James Monroe McCarty, Benjamin McCarty Jr., Jonathan McCarty, Abner McCarty, and Isaac W. McCarty.

Benjamin and Sarah were among the earliest white settlers in the Franklin County, Indiana region. The area had been occupied by various Native American tribes who ultimately abandoned their claims in the region. On May 25, 1803, Benjamin McCarty signed for the first land entry in the county, a site in New Trenton. When the area was officially established in 1811 as the 7th county in Indiana Territory, it officially was named Franklin County in honor of Benjamin Franklin.

Benjamin McCarty died on August 16, 1837, in Brookville, Indiana (Franklin County) and initially was buried in the Brier-Sims cemetery, but was moved to New Fairfield Cemetery when the Brookville Reservoir was built. His wife, Sarah, also was initially buried in Brier-Sims and then moved to New Fairfield.

Hanna and James Wright personally appeared before me Elijah Barwick a Justice of the Peace in & for the county aforesaid and being duly sworn depose and say that they did on this day appraise the goods and chattles belonging to the estate of the said Benjamin McCarty deceased exhibited to them by said exhibiter and as contained in the foregoing inventory proper to be appraised at their fair value the value of each article being annexed thereto and that said appraisement is just and true
