He was the son of James Scaggs (1769-1822) and 2nd wife Mary Ann Hite Brinker (1770-1856). He married first Eleanora Perry and with her had the following children; Frances Scaggs 1828, James Perry Scaggs 1829-1876, Mary Lavina Scaggs b.1835-1918, Melvina "Millie" Forrest Scaggs 1836-1923 and Martha Krebs Scaggs 1844-1918. He then married Sarah "Sallie" Ann Brady (the widow Bounds) on 17 June 1850, they had no children.
