He was buried at Rockville Union Cemetery Rockville, Maryland in December 1940 because Saint Mary's Catholic Church in Rockville would not allow his burial in the family plot of the church cemetery because he was a non-practicing Catholic at the time of his death. His daughter Scottie, was able to reverse the Baltimore Diocese's verdict and, in 1975 Scott and Zelda's graves and marker were moved to Saint Mary's church cemetery. Today it is the most visited site in the cemetery.
