When Oklahoma Territory was opened to settlement in 1889. he established law practice in Kingfisher. A member of the consitutional convention in 1906-1907, Justice Kane took an important part in framing the state consitution, and in latter year was elected justice of the supreme court. He is the first member of the original supreme court to pass away. Since 1907 Justice Kane has coninually been elected from the third district. Aside from his service as a member of the supreme court, Justice Kane held but one office during his career, that of assistant United States Marshal in territorial days. His superior officer then was Patrick S Nagle, Marshal. In 1909 he married Kathleen Regen, of Kansas City who survives him, and three children.
