The son of Peyton Randolph Berkeley and Frances Ann Bannister Little Berkeley. He was a lineal descendant of Sir William Berkeley. He was educated at Hampden-Sydney and graduated in law from the University of Virginia. Robert was a sergeant in Company K of the Third Virginia Cavalry. He married Pattie Maria Price on June 12th, 1867 by Reverend Robert Lewis Dabney. In 1887 he was elected Commonwealth Attorney of Prince Edward County.
