He attended Dorchester County schools and Franklin College in Baltimore, studied law with a Baltimore attorney, and began a practice in Cambridge in 1829. Stewart was also active in several business ventures, including shipbuilding and home construction. In 1838 he was an unsuccessful candidate for the US House of Representatives, and he served in the Maryland House of Delegates from 1843 to 1845. Stewart was a Delegate to the Democratic national convention in 1844. From 1854 to 1855 he was a Judge of the Maryland Circuit Court. In 1854 he was elected to the US House of Representatives and served three terms, 1855 to 1861. In his second term Stewart was Chairman of the Committee on Patents. He was also a delegate to the Democratic national convention in 1856. He did not run for reelection in 1860 and returned to practicing law in Cambridge. In 1867 Stewart was elected a Judge of the state Court of Appeals and Presiding Judge of the Circuit Court that included Dorchester County, positions he was still serving in at his death.
