Herbold Protests about Being Classed as Dead

Marshalltown, Ia., Dec. 17. With an action pending in court to declare him legally dead, together with an application to settle his estate, Julius H. Herbold, a former resident of Eden township, this county, has written Clerk S. N. Reilly, of the district court, that he is far from dead, and will resist any action of the court to so declare him.
Herbold is living in Ardmore, S. D., having left this county seven years ago. Within that time no word has ever been heard from him, and his mother, Mrs. Christine Herbold, of Rhodes, mourned her son as dead. She made the application to have the court act and decree Herbold dead in order that his third interest in the estate of his father, Henry Herbold, might be administered. The estate is a valuable one and consists of a fine farm near Rhodes. (The Bayard Advocate, Thursday, December 23, 1915, Page 2, Column 5)


Julius Herbold, better known as "Jack", was born December 5, 1873, of Mr. and Mrs. Henry Herbold, on a farm in Jasper County, Iowa.
At the age of 33 he started working for the Burlington railroad, operating out of Alliance, Nebr. and continued in this line of work until 1913. He then operated a pool hall in Edgemont for about seven years. For about 19 years he was engaged in farm and ranch work on different locations in this area. In 1939 he purchased a farm south of Edgemont which he continued to operate until his death. During the past two or three years he was in poor health and was confined to the Lutheran Hospital for treatment for many days.
Jack Herbold had formed a wide-circle of friends among the railroad workers, the ranch and farm owners and in Edgemont. The only known survivor is a sister, Mrs. Sophia Shryock of Roads (sic. Rhodes), Iowa.
"Jack" was laid to rest in the Edgemont cemetery Oct. 21. (The Edgemont Tribune, Edgemont, South Dakota, Wednesday, November 2, 1955)

Note: I have been told that Julius never married.
